1. Introduction

Welcome to Pocket Crusade! These Terms of Service ("Terms") govern your use of the game provided by Roman Darahan ("we," "us," or "our"). By downloading or playing the game, you agree to these Terms.

2. License to Use

We grant you a non-exclusive, non-transferable, revocable limited license to access and use the game for your own personal, non-commercial entertainment purposes. You agree not to use the game for any other purpose.

3. Virtual Items and In-App Purchases (IAP)

Our game may include "virtual currency" (e.g., gems, coins) or "virtual items."

• Consumables: You acknowledge that "Consumables" (e.g., gems, coins, spells, packs) are exhausted upon use in-game. Unlike non-consumables, these may not be restorable via iCloud if the local save is deleted without a prior sync.

• Billing & Refunds: All transactions are processed by Apple Inc. via the App Store. We do not collect or store your credit card information. Any requests for refunds must be directed to Apple Support.

• No Property Interest: You do not "own" virtual items; you have a limited, revocable license to use them within the game. We reserve the right to manage, regulate, or eliminate virtual items at any time without liability.

4. Prohibited Conduct & Integrity

In addition to the restrictions in Section 1, you agree not to:

• Data Manipulation: Manually modify, intercept, or "hex edit" local save files or iCloud metadata to artificially increase virtual currency balances.

• Derivative Works: Create any derivative works based on the Game’s assets, including "modding" or redistributing game files.

• Technical Circumvention: Use any unauthorized third-party software that intercepts, "mines," or otherwise collects information from or through the Game.

5. Intellectual Property

All content in the game—including code, graphics, music, characters, and titles—is the property of Roman Darahan or our licensors. You do not gain any ownership rights by playing the game or purchasing virtual items.

6. Termination

We reserve the right to suspend or terminate your access to the game (including deleting your account and virtual items) without notice if you violate these Terms. We also reserve the right to stop supporting the game at any time.

7. Disclaimer of Warranties & Limitation of Liability

• "As Is" Basis: The Game is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose.

• Data Loss: We are not responsible for any loss of game progress, virtual items, or data resulting from: (a) iCloud synchronization errors; (b) hardware failure; (c) uninstallation of the app; or (d) third-party updates to the iOS operating system.

• Cap on Liability: To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, or consequential damages. In all events, our total liability to you for all claims arising out of or relating to these Terms or your use of the Game shall not exceed fifty dollars ($50.00). This limitation applies even if the $50.00 amount fails its essential purpose or if we have been advised of the possibility of such damages.

8. Changes to Terms

We may update these Terms from time to time. Your continued use of the game after an update constitutes your acceptance of the new Terms.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of Dnipro.
